Rules
How to Enter:
1. NO PURCHASE NECESSARY. VOID WHERE PROHIBITED.
Sweepstake begins at 12:01 am (ET) on
April, 11 2008 and
ends at 11:59 pm (ET) on June 30, 2008. Any entries
received before or after these times will be voided.
2. An official entry form can be found
HERE.
By participating, entrant fully and unconditionally agrees
to and accepts these Official Rules and the decisions of
Sponsor, which are final and binding in all respects.
3. One entry per day per household per e-mail per
computer per IP. Household is defined as anyone living at
one specific residence. Email is defined as ONE e-mail per
person.
4. This Sweepstakes is open to legal residents United
States who are 18 or older.
5. Winners will be selected at random by Sponsor from
all eligible entrants on or about July 5, 2008. The odds
of winning depend on the number of eligible entries
received. The winner will be notified by mail and/or by
email on or about July 15, 2008. Return of any prize
notification as undeliverable will result in
disqualification and selection of an alternate winner.
6. Prizes:
- One (1) Grand Prize Winner shall receive a $500.00
VISA Gift Card.
- One (1) 1st Place Winner shall receive a $50.00 San
Marco Coffee Gift Card.
- Two (2)
Bonus Prize Winners
shall receive a $25.00 San Marco Coffee Gift Card.
7. No transfers, substitutions in prizes or cash will be
allowed except by Sponsor, who may substitute a prize of
equal or greater value.
8. The winner must comply with all instructions in the
prize notification letter, including the completion of an
affidavit of eligibility and liability/publicity release,
and return them within fifteen days of the date on the prize
notification letter; otherwise prize will be forfeited and
an alternate winner will be selected. By entering and/or by
accepting a prize, you agree to be bound by these rules and
to release Sponsors from any and all liability arising out
of your participation in this Sweepstakes and the awarding,
receipt, use and/or misuse of any prize.
9. Publicity: Except where prohibited, participation in the
Sweepstakes constitutes winner's consent to Sponsor's use of winner's name,
likeness, voice, opinions, biographical information, hometown and state for
promotional purposes in any media without further payment or consideration.
10. Entries that are lost, late, illegible, incomplete or
voided for any reason will not be eligible. Entry materials
that have been tampered with or altered are void. In the
event of a dispute concerning the identity of the person
submitting an entry, the entry will be deemed to be
submitted by the person in whose name the email account is
registered. This Sweepstakes is governed by the laws of the
United States with venue in Broward country in the State of
Florida.
11. For a winners' list, mail a self-addressed, stamped
envelope to: Winner of “San Marco Sweepstakes V”, 3120
Latrobe Dr. Ste 280 Charlotte, NC 28211. Beginning on or
about July 15, 2008. Requests received after
August 16,
2008 will not be honored. All winners will be posted
here on or before
July 15, 2008.
12. Release: By entering this Sweepstakes, entrant agrees to release
and hold harmless San Marco Coffee, Inc., the Released Parties (as defined
below) and companies providing prizing, and each of their respective related
companies, agencies and each such company's officers, directors, employees and
agents from and against any claim or cause of action arising out of
participation in the Sweepstakes or receipt, redemption or use of the prize.
13. Limitations of Liability: Sponsor, San Marco Coffee, Inc., and
their respective agents, directors, officers, shareholders, employees, insurers,
servants, parents, subsidiaries, divisions, affiliates, predecessors,
successors, representatives, advertising, promotion, and fulfillment agencies,
and legal advisors (collectively, the “Released Parties”) are not responsible
for: (i) technical failures of any kind, including but not limited to the
malfunctioning of any computer, cable, network, hardware or software; (ii) the
unavailability or inaccessibility of any transmissions or telephone or Internet
service; (iii) unauthorized human intervention in any part of the entry process
or the Sweepstakes; (iv) electronic or human error which may occur in the
administration of the Sweepstakes or the processing of entries; (v) any injury
or damage to persons or property, including but not limited to entrant's
computer, hardware or software, which may be caused, directly or indirectly, in
whole or in part, from entrant's participation in the Sweepstakes; or (vi) any
printing or typographical errors in any Sweepstakes-related materials; stolen,
lost, late, misdirected, damaged, incomplete, or illegible entries.
14. General Conditions: Sponsor reserves the right to cancel or modify
the Sweepstakes if fraud, technical failures or any other factor beyond
Sponsor's reasonable control impairs the integrity of the Sweepstakes, as
determined by Sponsor in its sole discretion. In such event, Sponsor reserves
the right to award the prizes at random from among the eligible entries received
up to the time of the impairment. Sponsor reserves the right in its sole
discretion to disqualify any individual it finds to be tampering with the entry
process or the operation of the Sweepstakes or to be acting in violation of
these Official Rules or in an unsportsmanlike or disruptive manner. Any attempt
by any person to deliberately damage any web site or undermine the legitimate
operation of the Sweepstakes is a violation of criminal and civil law, and,
should such an attempt be made, Sponsor reserves the right to seek damages from
any such person to the fullest extent permitted by law. Sponsor's failure to
enforce any term of these Official Rules shall not constitute a waiver of that
provision.
